1. PARTIES AND ACCEPTANCE OF THE GENERAL CONDITIONS OF CONTRACTING:

(hereinafter also the General Conditions or CGC) :

On the one hand, the provider of the management of accommodation reservations in FORTACO, SL , (hereinafter also the provider and HOTEL ACAPULCO ) , with registered office at C/ Josep de Togores 21, 17310, Lloret de Mar, NIF B17120445 , customer service telephone number 972 36 54 98 , and e-mail: info@hotelacapulcolloret.com , being the owner of the website www.hotelacapulcolloret.com , sets out the contractual document that will govern the contracting of hotel room reservations through the reviewed website.

And on the other hand, the User – Client ( hereinafter the User) , who makes the reservation and is responsible for the veracity of the personal data provided to the provider.

BOTH accept this document, and it implies that the user:

He has read, understands and understands what is presented here.

That he is an adult and with sufficient capacity to hire.

That assumes all the obligations set out here.

That you have read and accept these general conditions of purchase from the moment you make any reservation.

This document can be printed and stored by Users.

The lender makes available to them the e-mail address info@hotelacapulcolloret.com so that they can raise any doubts about these conditions.

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider's website www.hotelacapulcolloret.com .

The provider reserves the right to unilaterally modify these General Conditions, without this affecting the reservations or promotions that were acquired prior to the modification, in order to improve the services offered. In any case, these general conditions must be consulted before booking.

It is advisable to keep a copy of the data contained in the reservation. HOTEL ACAPULCO is not responsible for any loss of data, files or any damage resulting from a failure to backup the data contained in the reservation made by the User.

The civil liability of HOTEL ACAPULCO for the services provided is limited to the amount of the same, the user waives any responsibility to HOTEL ACAPULCO for any concept in any case of dissatisfaction with the services purchased on the website www.hotelacapulcolloret.com , as well as possible failures, slowness of access or errors in accessing the website, including loss of data or other types of information that could exist on the computer or network of the user who accesses the website www.hotelacapulcolloret.com .

HOTEL ACAPULCO makes available room reservations at the hotel remotely via the Internet through its website or in person at the hotel facilities at C/ Josep de Togores 21, 17310, Lloret de Mar.

 

2. PURPOSE OF THE CONTRACT:

2.1 Scope of application : The purpose of this contract is to regulate the contractual relationship of reservation of accommodation, which involves the reservation of the chosen room, for a limited time, in exchange for a price determined and publicly displayed through the website. The extra services must be contracted at the time of making the reservation. The user accepts these reservation conditions during the online hiring process by checking the corresponding box. These CGC will apply from the day the reservation is made.

2.2 Territory of application : The possibility of reservations on www.hotelacapulcolloret.com is active worldwide.

2.3 Capacity to hire : To be able to make a reservation you must be of legal age and have capacity to hire.

2.4 Customer acceptance : The validation of a reservation through the website www.hotelacapulcolloret.com is done by email and also implies the automatic acceptance of the CGC. These conditions are available on the website www.hotelacapulcolloret.com or, if you wish and request, we can make them available by email.

2.5. Modification of the General Conditions of Contract : HOTEL ACAPULCO reserves the right to make changes and/or modifications in these CGC. We advise our clients to review them regularly. In the event that these changes or modifications are introduced once a reservation has been made, the conditions in force on the date on which said reservation was made will apply.

 

3. INFORMATION PROVIDED ON THE WEBSITE www.hotelacapulcolloret.com :

3.1 Publication of prices : The prices of the rooms are those shown in the information for each one of them on our website www.hotelacapulcolloret.com .

There are reservation methods that offer discounts or benefits at the time of cancellation and which we go on to detail:

Flexible modality: totally flexible cancellation policy up to 1 day before your arrival. The cancellation is detailed in section 8 of these conditions.

Discount that will be applied in the purchase process. This modality requires paying 100% of the total amount 1 day before the date of arrival.

Long stay modality: reservations of more than 5 nights are considered long stays and this modality offers a 10% discount on the reservation. Discount that will be applied in the purchase process.

The prices of the extra services are shown at the time of making the reservation. The details of the cancellation methods are set out in the room information and in section 8 of these conditions.

Modalidad Non-refundable resale : requires prepayment of 100% of the reservation at the time of reservation with the conditions of the offer.

3.2 Information about the rooms: The information that appears in our advertising, brochures, other written material, on our website or provided to you. constitutes an invitation to make a purchase. The contents of www.hotelacapulcolloret.com are constantly renewed and updated to offer our clients the most complete and detailed information possible. All the contractual information on www.hotelacapulcolloret.com is displayed in Spanish (Castilian), Catalan, English, French, Russian and German and communication with clients and users, as well as the formalization of the contract, can be done in any of these languages.

3.3 Availability of the room(s): The published rooms are available. the room in question is visible but not available for reservation.

3.4 Reservations 24 hours a day, every day of the year: The hotel is open to the public seasonally. The opening period in 2024 will be from 03/23/2024 to 10/16/2024. Reservation reception hours for those dates via the web are twenty-four (24) hours a day, 365 days. Once the reservation is made, you will automatically receive an email confirming the process and another confirming the purchase when the provider has received and confirmed the payment corresponding to the amount of the reservation.

3.5 Fraud : If HOTEL ACAPULCO suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

 

4. RESERVATION PROCEDURE:

In order to be able to access the services offered by the provider, the user must not register through the website by creating a user account. Only the essential data will be requested to be able to process your reservation.

Once the room (s ) you wish to reserve has been selected, please be informed that in accordance with the requirements of art. 27 of Law 34/2002 on Services of the Information Society and Electronic Commerce, the contracting procedure will follow the following steps:

Choose the desired rental by clicking on it, and it will be added to the shopping cart by clicking on the "reserve" button.

If you want to add more reservations, you must look for the reservation that suits your request. If by mistake you have added a reservation that you did not want, you must click on the option to remove from my basket.

Once you have chosen the reservation(s), you must click next, where the extra services you want to reserve will appear and once you have passed this step you can click on "reserve" to make the reservation. By clicking on this option, the confirmation of the purchase will appear (summary of the reservations made and extras if applicable, their data and chosen form of payment).

A series of personal data will be requested to be able to make the reservation, and then the user's consent to save their data is requested. If you provide it, it will be saved and you will be sent information about our services and/or offers if you allow it, otherwise the data will be saved for future purchases only.

You should check your email inbox for spam and junk mail and always verify that the contact information you provide is correct.

Once your data has been filled in, the total amount of the reservation and the amount referring to the advance will appear, along with a check box that must be marked since it is the acceptance of these General Terms and Conditions of Contract and the Privacy Policy.

To end the process, you must click on the Finish button.

In any case, the provider's recruitment platform will inform the user, once the recruitment procedure has been completed, via email regarding all characteristics, price, recruitment date and booking dates.

If there is any type of error in the indicated address or in any other point of the reservation, you must notify it immediately to the indicated e-mail address to proceed with the correction of this error.

HOTEL ACAPULCO will provide FREE Customer Service through our contact email info@hotelacapulcolloret.com , if you choose an alternative means of communication, the user is responsible for the particular cost of this.

HOTEL ACAPULCO makes available telephones in Spain subject to the cost of its telephone operator.

 

5. RESERVATION CONFIRMATION

The LENDER will reserve the room under the terms of payment.

At the time of completion of the online reservation, we will send the payment conditions and reservation data to the email address you provided when making the reservation.

If there is any error in the data, you must immediately contact our Customer Service line 972 36 54 98 or send an email to info@hotelacapulcolloret.com , to be able to proceed with the appropriate rectification.

 

6. PRICES AND VALIDITY PERIOD OF OFFERS:

All prices displayed in the shop www.hotelacapulcolloret.com include the VAT in force at the time of booking. All prices listed on the website are valid and will be expressed in Euro ( €). These costs, unless expressly indicated otherwise, do not include cancellation costs, nor do they include tourist taxes and/or travel insurance.

The user will receive the invoice for the reservation to the email address provided by the user once the reservation has been made.

The prices applicable to each rental of the accommodation will be those published on the web and applied automatically by the contracting process in the last phase of the same .

In the case of promotions of limited duration, the discount of the promotion will always be applied and when the reservation has been registered during the promotion period.

The data recorded by the different payment methods constitute proof of the date on which the financial transactions were made and will be used to determine whether or not said reservation is subject to promotion.

For any information about the reservation, the User can contact the provider's customer service number or via email at the address provided.

 

7. PAYMENT METHODS

Below, we detail the available systems:

7.1 Payment by credit or debit card : The user must have a valid credit or debit card, where they must specify all the digits of the card number in the corresponding form. The operation is formalized at the time of placing the order. Payments are only accepted with secure cards in which the identity of the cardholder is authenticated according to the method established by your bank, through secure electronic commerce (" Verified by Visa" and "MasterCard SecureCode "). The order will not be taken into account and will not be processed until the payment has been authorized by your bank or cash register.

Secure Sockets Layer ) is used , a payment system in a secure environment that allows the encryption of the information transmitted during the transaction, ensuring its confidentiality .

We charge the full amount of reservations 24 hours before check-in .

7.2 Payment via transfer or bank deposit : At the moment of finalizing the order, the user will receive instructions with the account number to pay for the order. It is essential that the assigned order number and the user number are clearly indicated in the transfer order. In order to confirm the order, it will be necessary to do it within 7 days, otherwise it will be canceled in our system.

7.3 PayPal : Once the purchase is complete, if you choose this form of payment, you will be redirected to the official PayPal website where you can make the payment. Once the payment has been made correctly, your order will be finalized and an email will be sent with a summary of your purchase. Pressing the "Back to the web" button will return to the web to see the order and be able to print it.

PayPal automatically encodes confidential data with the help of the most advanced technologies available on the market. PayPal has its own privacy policies and HOTEL ACAPULCO has no responsibility for them.

 

8. CANCELLATION AND PAYMENT CONDITIONS

The right of withdrawal will not apply to contracts that refer to the provision of accommodation services for purposes other than housing if the contracts provide for a specific date or period of execution.

The reservation can be canceled in three different ways depending on the rate selected and the type of reservation made:

The flexible rate : free cancellation up to 1 day before arrival.

Best rate available : you can modify or cancel the reservation up to 24 hours before arrival and you will not pay anything until you arrive at the hotel. If you cancel in the previous 24 hours, 50% of the total amount of the reservation will be charged.

Long stay : if you book a long stay reservation (considered a long stay from 5 nights) you can cancel your reservation up to the day before your arrival. 100% is charged 1 day before arrival.

Non-refundable resaleable : 100% prepayment when making the reservation, follow the processes of the Takyon.io platform

Cancellations must be requested in writing via email to info@hotelacapulcolloret.com .

If the reserved accommodation is not occupied on the day of arrival or at the latest on the following day before 12 o'clock, the reservation will be canceled automatically, unless we have been notified in writing of the delay.

In case of delay on the day of arrival or early departure in any way, 100% will be charged, unless an agreement is reached between both parties.

 

9. CONDITIONS OF THE STAY

Minimum age: The minimum age to stay at Hotel Acapulco is 21 years. The booking holder must be at least 21 years old upon arrival. All guests under 21 years of age staying at the hotel must be accompanied by a person aged 21 or older who shares the same room and takes full responsibility for them during the stay. In the case of sports or educational groups, the presence of at least one adult supervisor responsible for the group is required.

Arrivals : The accommodation can be occupied on the day of arrival from 2pm.

Upon arrival and in accordance with current legislation, the USER must hand in the reservation sheet and all occupants of the accommodation will be identified.

The tourist tax will be applied according to current legislation and will be paid at the reception upon arrival.

Departures : you must leave yourself free on the planned day of departure before 12:00 in the morning.

Extra services :

If the USER is interested in hiring an extra service, he must do so at the time of making the reservation:

Cot: Free

Late check out (until 7pm): €30 per room.

Parking : €10 per night.

Half board: €8 per day per person

Full board: €16 per day per person

Hot tub: €5 per night.

CAVA: €16 per bottle

Therapeutic massage (25 minutes): €35 per massage

Responsibilities of the client:

The USER undertakes to respect the Hotel's regulations. During the rest hours from 10:00 p.m. to 8:00 a.m., it is not allowed to use the rooms for the purposes of party celebrations, nor to make noise. In no case is it allowed to occupy the room by more people than those established in its maximum capacity.

It is forbidden to hang towels and clothes on the railings of the balconies.

The pool hours are set by each Community and are generally from 9:00 to 19:30. It is forbidden to nail objects such as parasols, awnings, etc. on the lawn, as well as using inflatable mattresses inside the pool.

Children must always be accompanied by their parents and under their responsibility.

The USER is responsible for the correct behavior of all his booking companions, in the opposite case, the LENDER reserves the right to expel the occupants of the accommodation, without the right to future claims or any type of compensation.

HOTEL ACAPULCO, will not be responsible for any direct or indirect damage that may be caused as a result of misuse of the room, including without limitation: destruction, losses after fires, theft, crime, accidents or other types of damage.

Animals are not accepted in the hotel.

The lender will not be responsible for booking errors attributable to the user or caused by unavoidable and extraordinary circumstances.

 

10. NULLITY AND INEFFICIENCY OF THE CLAUSES:

If any clause included in these General Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, the General Conditions subsisting in everything else, having such provision, or the part of it that is affected, by not putting.

 

11. RESOLUTION OF ONLINE DISPUTES (ONLINE DISPUTE RESOLUTION):

According to Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the USER and the LENDER, without the need to resort to the courts, through the intervention of a third party, called the Litigation Resolution Body , which acts as an intermediary between the two. This body is neutral and will dialogue with both parties to reach an agreement, finally being able to suggest and/or impose a solution to the conflict. 12. APPLICABLE LAW AND JURISDICTION:

These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. The provider and the user agree to submit any dispute that could arise from the provision of the service subject to these Conditions, to the Courts and Tribunals of the domicile of the provider (if not considered as a consumer for the purposes of the TRLGDCU) or of the user (if considered as a consumer for the purposes of the TRLGDCU).

 

13. APPLICABLE REGULATIONS:

These General Conditions are subject to the provisions of:

European regulations governing electronic commerce:

  • Directive 97/7/CE relating to the protection of consumers in the matter of distance contracts (Distance Sales Directive);
  • Directive 2000/31/CE relating to certain legal aspects of information society services, in particular electronic commerce in the internal market (Directive on electronic commerce).
